If you receive an employment tribunal claim, you will have 28 days to file the employer’s response to the claim. It is important to file the response because otherwise the employment tribunal could make a default judgment in favour of the claimant.
Defending a tribunal claim will involve our specialist employment solicitor speaking with managers and work colleagues who are involved in the matters detailed in the claim form to obtain their witness evidence and identifying relevant documents for evidence, including, as appropriate, emails, minutes of meetings, investigation reports, grievance and disciplinary outcomes and policy documents. Acas are notified of the claim from the outset and discussions with the claimant can be attempted at any stage to reach a conciliated settlement, thereby avoiding the dispute being decided in a tribunal hearing.
